AGREEMENT (PUBLIC OFFER)
on confidentiality and processing of personal data when using the website https://gamingpc.com.ua
Limited Liability Company «APPDATA», USREOU code 45727177, individual tax number 457271726509, registered address: Ukraine, Kyiv, 4 Mykoly Hrinchenko Street, represented by Director Nataliia Serhiivna Kyrylova, acting on the basis of the Articles of Association (hereinafter – «Party 1», «Personal Data Controller», «Website Operator»), on the one hand, and any individual who uses the website https://gamingpc.com.ua, places orders, registers on the website and/or otherwise interacts with the online platform (hereinafter – «Party 2», «User», «Buyer»), on the other hand, together – «the Parties», have entered into this Agreement as follows.
The act of using the Website, completing forms, registering an account, placing an order, ticking the box indicating acceptance of the Agreement terms on the Website and/or any other explicit action by the User indicating acceptance of the terms constitutes the User’s full and unconditional accession to this Agreement.
1. DEFINITIONS
1.1. Confidential Information – any information transmitted by one Party to the other in written, electronic or oral form that has commercial, official or other value, including but not limited to: business documentation, financial information, technical data, databases, personal data, order information, commercial plans, software, know-how and other information that is not publicly available.
1.2. Personal Data – information or a set of information about an individual who is identified or can be specifically identified.
1.3. Processing of Personal Data – any action or set of actions performed wholly or partially in an information (automated) system and/or in personal data filing systems, including but not limited to: collection, registration, accumulation, storage, adaptation, modification, use, dissemination, transfer, anonymisation, blocking or destruction of personal data.
1.4. Website / Online Platform – the internet resource https://gamingpc.com.ua (online store «gamingpc.com.ua»), owned by Party 1 and used for the sale of goods, provision of services and communication with Users.
2. SUBJECT MATTER OF THE AGREEMENT
2.1. Under this Agreement, the Parties undertake to ensure non-disclosure of confidential information and establish the procedure for collecting, storing, using and protecting the User’s personal data that may be obtained through the use of the Website, placement of orders and/or other interactions between the Parties.
2.2. The Parties undertake to use confidential information and personal data solely for the purpose of the proper operation of the Website, fulfilment of obligations under purchase and sale agreements, provision of services, and in accordance with the requirements of applicable Ukrainian legislation.
3. COLLECTION AND PROCESSING OF PERSONAL DATA ON THE WEBSITE
3.1. When using the Website, Party 1 may process the User’s personal data, including:
last name, first name, patronymic;
contact phone numbers, email address;
delivery address (locality, street, building number, apartment number, delivery service branch, etc.);
data on placed orders, purchase history, applied discounts;
technical data: IP address, device and browser information, cookies, information about interaction with the Website (pages visited, time of visit, etc.).
3.2. The User’s personal data is processed for the following purposes:
registration and maintenance of User accounts;
placement, confirmation, processing and fulfilment of orders;
processing payments for goods/services;
organising delivery of goods and handling User enquiries;
providing consultancy support;
compliance with legal requirements (tax, accounting and other);
informing the User about order status, promotions and special offers (subject to separate consent to receive marketing communications).
3.3. The legal grounds for processing personal data are:
the User’s consent given when using the Website, completing forms, registering or placing an order;
necessity of performing a contract to which the User is a party;
compliance with Ukrainian legislation;
legitimate interests of Party 1 that do not infringe the rights and freedoms of the User.
3.4. The provision of incomplete or inaccurate personal data by the User may make it impossible to properly provide services, place and/or fulfil orders.
4. USER RIGHTS REGARDING PERSONAL DATA
4.1. The processing of the User’s personal data is carried out in accordance with Ukrainian legislation, in particular the Law of Ukraine «On Personal Data Protection» and the Law of Ukraine «On Consumer Rights Protection».
4.2. The User has the right to:
know the sources of collection and location of their personal data, the purposes of its processing, and the location or place of residence (stay) of the Personal Data Controller;
receive information on the conditions for granting access to personal data, including information about third parties to whom their personal data is transferred;
access their personal data;
request correction, updating, supplementation or deletion of their personal data in cases provided for by law;
withdraw their consent to the processing of personal data (to the extent that consent is the legal basis for processing) by contacting Party 1.
4.3. Party 1 undertakes to consider enquiries, applications or complaints from Users regarding the processing of personal data within the timeframes and in the manner prescribed by Ukrainian legislation.
5. TRANSFER OF PERSONAL DATA TO THIRD PARTIES
5.1. Party 1 may transfer the User’s personal data to third parties solely to the extent necessary to achieve the purposes specified in this Agreement, namely to:
delivery services (carriers);
payment services, banking institutions;
companies providing hosting, technical support for the Website and CRM systems;
accountants/outsourcing companies for compliance with tax and accounting legislation;
companies providing repair and warranty services
5.2. When transferring personal data, Party 1 requires such third parties to maintain an adequate level of personal data protection and confidentiality in accordance with Ukrainian legislation and (where necessary) separate confidentiality agreements.
5.3. Transfer of personal data to third parties for marketing purposes (mailings, affiliate programmes) may only be carried out with the prior separate consent of the User, unless otherwise provided by law.
6. PROTECTION OF CONFIDENTIAL INFORMATION AND PERSONAL DATA
6.1. Party 1 undertakes to implement appropriate technical and organisational measures to protect the User’s personal data and other confidential information from unauthorised or unlawful access, accidental loss, destruction, damage or disclosure.
6.2. The Parties acknowledge that no method of transmitting data over the Internet or method of electronic storage is 100% secure; however, Party 1 takes reasonable measures to minimise the relevant risks.
6.3. The User undertakes not to disclose their account credentials (username, password) to third parties, to use strong passwords, and to ensure adequate protection of the devices used to access the Website.
7. PERSONAL DATA RETENTION PERIOD
7.1. The User’s personal data is stored no longer than necessary for the purposes for which it was collected, or for the period established by Ukrainian legislation.
7.2. After the purpose of processing personal data has been achieved or the established retention period has expired, personal data may be destroyed or anonymised, unless otherwise provided by law.
8. LIABILITY OF THE PARTIES
8.1. In the event of a breach of the terms of this Agreement, the guilty Party shall be liable in accordance with applicable Ukrainian legislation and shall compensate the other Party for losses caused by the unlawful disclosure of confidential information or unlawful processing of personal data.
8.2. Party 1 shall not be liable for damage caused as a result of:
actions or omissions of the User themselves;
the User providing inaccurate or incomplete data;
unlawful actions of third parties, provided that Party 1 has duly fulfilled its data protection obligations.
9. AMENDMENTS AND TERMINATION OF THE AGREEMENT
9.1. This Agreement enters into force from the moment of the User’s first visit to the Website and/or the performance of actions indicating acceptance of the Agreement terms, and remains in effect for the entire period of use of the Website.
9.2. Party 1 has the right to unilaterally amend the terms of this Agreement by publishing a new version on the Website. The new version enters into force from the moment of its publication, unless otherwise specified therein.
9.3. Continued use of the Website following amendments to the Agreement constitutes the User’s acceptance of such amendments.
9.4. The User’s cessation of use of the Website does not release the Parties from their obligations regarding non-disclosure of confidential information and protection of personal data for the period defined by law and this Agreement.
