1.General Provisions

1.1 This Privacy Policy (hereinafter - "Policy") is developed by GamingPC in accordance with the current legislation of Ukraine, including, but not limited to the Law of Ukraine "On Protection of Personal Data" dated June 01, 2010 № 2297-VI, taking into account the principles and rules of the General Data Protection Regulation (GDPR) of the European Union in relation to the Users of the Portal gamingpc.com.ua and establishes the procedure for receiving, collecting, accumulating, storing, processing, using, ensuring protection and disclosure of personal data (hereinafter - "Data") through the Portal and/or mobile application and / or related services and tools.

1.2 Data means any information relating directly or indirectly to a particular User. It can be: name, surname, patronymic (if any), information about occupation, marital status, education, e-mail address, telephone number, region of residence, address of residence/stay, information about the User's activities on the Website, Ip-address, data about the devices used by the User (computer, browser type, operating system of the mobile device), messages (information contained in correspondence between Users with each other, as well as in correspondence with the Administration of the Website), other communication information, information about the User's activities on the Website, information about the User's mobile application and/or related services and tools.

1.3 Data processing means any action with Data, including but not limited to: access, provision, distribution, collection, systematization, storage, accumulation, recording, transfer, blocking, deletion, clarification, updating and/or modification, depersonalization and other ways of using Data by the Company.

1.4 Users may provide Data on their own by posting them on the Portal or by communicating them via telephone channels and/or to the Company's e-mail and/or postal address, by filling out questionnaires (filling out a questionnaire or otherwise), or Data may be provided from other sources (in accordance with clause 3 of this Policy), such as User feedback (evaluations, comments, confirmation of information) or other information from third parties, provided in the course of submitting claims, complaints and/or disputes, and/or information from third parties.

1.5 The User has no right to use the site gamingpc.com.ua, if he does not agree with the terms of this Policy.

1.6 The User acknowledges that in case of his negligent attitude to the security and protection of his Data and authorization data (password, login) third parties can get unauthorized access to the account and Data of the User. The Company shall not be liable for any losses caused by such access.

2.What personal data may be collected

2.1 The Company may collect the following Data:

- name, surname, patronymic (if any), passport data, taxpayer account registration number, date of birth, and / or age, gender, marital status, data of the authorized person of the company, company name, company details, contact phone numbers, e-mail address, company location address, other communication data at the User's request (e.g. place and / or address of work), payment card numbers, payment card tokens (USB keys that are intended for the User's information security);

- information about the User's account (in particular login, phone number), e-mail address, login and password, account processing data, other Data necessary for providing services to the Users of the Website, communication with the Users, including in the process of User's contacting the Website support service;

- information that Users provide to the Company when concluding service agreements by accepting the public offer posted on the Website;

- information necessary for communication between the Users of the Website, including for realization and confirmation of transactions between sellers and buyers, receiving and sending messages, posting feedback, comments, making payments, for fulfillment of requests from Users and receiving feedback from the User if necessary, information posted by Users according to the results of their service, feedback, comments, requests to the customer support service, complaints, claims, other requests;

- data about the devices used by the User, information about the Users' websites and/or their mobile data (in case the User uses a mobile application) such as: ip-address, date and time when the User uses the Portal, information about the software and the Internet browser used, information about the operating system of the mobile device, information about the operation of the User's devices, individual identifiers of the devices used by the Users;

- data obtained as a result of various surveys conducted by the Company and/or third persons authorized by the Company in order to improve the provision of services to Users; information obtained by the Company as a result of marketing activities;

- information about User's actions on the Website (consumer behavior regarding purchase of goods, performance of works, rendering of services on the Website) information based on the results of communication with other Users, including information left by Users in feedback forms, evaluation, comments or any other feedback from Users; information on the basis of which ratings are formed, any other information posted by Users on the Website as a result of interaction with other Users and which enables the Company to provide information about the User's activity on the Website; information about the User's activities on the Website; information about the User's activities on the Website (consumer behavior regarding purchase of goods, performance of works, rendering of services on the Website).

- information posted or provided to Users in the process of their participation in bonus programs, quizzes, promotions, special offers held on the Website and organized by the Company;

- information received from Users by filling in questionnaires or otherwise brought to the notice of the Administration of the Website (it may be information including but not limited to: citizenship, place of birth, education, profession, specialization, experience, social status, family composition (surname, name, patronymic of such persons, their gender, age, place of registration and residence, contact details), photo, video image of the User (and / or authorized person of the User, etc.);

- the information is obtained in a lawful manner from partners and/or third parties.

2.2 The Company may also process Data using the following technologies:

- cookies (cookies - a small piece of data that is sent to the User's computer when going to a web page and/or when viewing an advertising module on a web page and stored on the User's computer and/or mobile device);

- pixels (pixels are digital images, an element of the matrix of displays that form an image), which allow tracking how often the User uses the web page in order to determine the User's browser and to provide services, such as storing Data in the shopping cart between visits; as well as to eliminate errors in the operation of the Portal initiated by the User, all information is processed "as is" and is not changed during the collection of Data.

3.Use, exchange and purposes of Data processing

3.1 The Website uses and processes Data for the purposes of:

- to carry out the functions, powers and duties assigned to the Company in accordance with the current legislation of Ukraine, also to ensure the realization of civil, economic and tax relations;

- to identify the client as a User of the Portal, for the purpose of communication with Users, including for the provision of services, processing payments, sending settlement operations, reporting, accounting and management accounting, creation and implementation of bonus programs, loyalty programs, sending mailings by mail, e-mail, to the cell phone number, including for the purpose of sending commercial offers, notification of promotions and news, as well as other portals/sites, and/or to notify the User.

-sending mailings, commercial offers, notifications about promotions, loyalty programs, bonus programs and/or for the purpose of sending messages about the functioning of the Portal and/or other portals / sites, which are at the disposal of / or owned by the mail, e-mail

- provision by the Company of Internet services of the site, exchange of information.

The Company may exchange Data with the Company's affiliates (companies that act on the basis of common ownership), which may process and use Data for the purpose specified in section 3 of this Policy.

3.2 The Company does not process Data relating to race, nationality, political views, religious and other beliefs, membership in public associations. Information that characterizes physiological features of Users, on the basis of which it is possible to establish his/her identity, is not processed.

3.3 The terms of processing and storage of Data are determined on the basis of the purposes of Data processing, as well as on the basis of the conditions specified in the contracts concluded with Users in accordance with the requirements of the current legislation of Ukraine.

4.Conditions of providing access to Data

4.1 Disclosure of Data is made when the User orders goods/services on gamingpc.com.ua to the seller/provider of such goods/services, but only to the extent necessary to identify the User and his order.

4.2 In some cases, in order to demonstrate the effectiveness of the Portal and improve the image of the Portal, the Company may disclose the statistics of the work of the Users' sites, without disclosing personal data and information that is a commercial secret.

4.3 The site gamingpc.com.ua, among other things, provides an opportunity to use the API of Youtube service. Personal data of Users using Youtube API services are processed, stored and transferred in accordance with the Terms of Use of YouTube API services.

4.4 The Portal contains links to other web resources when Users navigate to them, which are not covered by this Policy.

4.5 The Company processes Data on a lawful and fair basis: Data shall not be disclosed to third parties and shall not be disseminated without the User's consent, except as provided for by the current legislation of Ukraine and only in the interests of national security, economic well-being and human rights, in particular but not exclusively:

- at the reasonable requests of state authorities authorized to request and receive such data;

4.6 The Company reserves the right, in accordance with the requirements of the current legislation of Ukraine, to exchange Data with state authorities in order to: prevent fraud on the Website, settle disputes and clarify circumstances that may be/become the reason for violation of the current legislation, as well as in case the Company identifies illegal actions of the Website Users and/or receive claims, complaints, appeals from third parties.

5.How to change/delete Data or withdraw consent

5.1 Users can change/delete personal information or unsubscribe from sending messages, or withdraw their consent to the processing of Data at any time.

5.2 Upon receipt of such notification, the processing of the User's Data will be terminated and the User's Data will be deleted, unless such processing may be necessary in accordance with applicable Ukrainian law.

5.4 The Company shall process and store the Data for realization of the purposes specified in this Policy for the whole period necessary for this purpose, but not more than 5 (five) years from the date of the last interaction of the User with the Portal.

6.Data protection

6.1 When processing Data, the Company applies all necessary technical, organizational, legal measures to protect Data from unlawful and/or unauthorized access to such Data, including modification, deletion, provision, distribution, as well as other unlawful actions.

6.2 The Company shall monitor the security measures taken on an ongoing basis.

7.ADDITIONAL TERMS AND CONDITIONS

7.1 The Company reserves the right to change the terms of this Policy at any time. The User does not agree with the changes, he/she undertakes to immediately discontinue any use of the Portal.

7.2 The Website shall not be liable for any damage or loss suffered by the User or third parties as a result of misunderstanding or misunderstanding of the terms of this Policy.

7.3 In the event that the provisions of this Policy, clauses or any part thereof, are found to be in such a way as to be contrary to the current legislation of Ukraine, or invalid, this fact shall in no way affect the remaining provisions of this Policy, they shall remain in full force and effect and shall be valid, and any invalid provision, or provision that cannot be complied with, without further action by the Parties, shall be deemed to be modified, amended to the extent necessary to ensure its validity and enforceability.

7.4 Terminology used in this Policy has the same meaning as in the User Agreement unless otherwise specified.
